Court Sides with Winegard’s claims

BURLINGTON, Iowa (Dec. 3, 2012) – Winegard Company, a global leader in antenna design, announced that on November 16, 2012, the United States Court of Appeals for the Federal Circuit, Washington D.C., affirmed the jury verdict in its favor in the ongoing patent lawsuit against Electronic Controlled Systems, Inc. d/b/a King Controls.

King Controls had previously accused Winegard's Carryout® product of infringing claims of two U.S. Patents owned by King Controls and had asserted more than $5 million in damages. Winegard stipulated that the Carryout® product infringed the patents but argued and later proved the patents were invalid as obvious. A five-day jury trial was held in November 2011, where the jury returned a unanimous verdict in favor of Winegard in just over two hours of deliberations.

Winegard was represented at oral argument by Robert V.P. Waterman, Jr. With him on brief was April A. Marshall, both from the law firm of Lane & Waterman LLP in Davenport, Iowa.
